General Terms and Conditions for Vehicle Rental

1. Definitions
1.1. Company/Lessor – AUTORENT PLATINUM SRL, registered with the Trade Register under No. J2021012542407, Tax ID 44621379, EUID ROONRC.J2021012542407, acting as owner and lessor of the vehicles.
1.2. Client/Lessee – The natural or legal person whose identification data is stated in the Rental Form, renting the vehicle under this Agreement.
1.3. Rental Agreement – The Rental Form signed by both parties, together with these General Terms and the Handover Protocol.
1.4. Vehicle – The vehicle subject to this Agreement, together with all accessories, documents, and related equipment.
1.5. Rental Fee – The base rate for each rental day plus additional costs as per the Client's options.
1.6. Deposit – The amount paid by the Client upon pickup, which may be retained by the Company under this Agreement.
1.7. Additional Driver – Any person other than the Client, named in the Rental Form, authorized to drive the Vehicle.
2. Rental Conditions
2.1. The Client must be at least 21 years old at the date of signing the Agreement.
2.2. The driving license must be valid in Romania (EU licenses accepted; non-EU licenses require an International Driving Permit), held for at least 1 year.
2.3. Upon pickup, the Client must present a valid ID card or passport, both in original. The Company will make copies.
2.4. Legal entities must present the company registration certificate and a power of attorney signed by the administrator.
2.5. Additional drivers must meet all conditions under 2.1-2.3. Driving by an unauthorized person results in full deposit forfeiture and liability for all damages.
2.6. The Company reserves the right to refuse a rental without stating a reason.
3. Duration. Extension. Return
3.1. The minimum rental period is 4 days. The rate is calculated per 24-hour intervals.
3.2. Exceeding the return deadline by more than 4 hours extends the Agreement by one additional day at the standard rate, provided the Company is notified in advance. Otherwise, the Vehicle will be reported as stolen.
3.3. Extension is made by mutual agreement, by phone or email.
3.4. Early return does not entitle the Client to a refund of amounts paid.
3.5. Selling, subletting, pledging, or any other disposal of the Vehicle is strictly forbidden.
4. Costs and Fees
4.1. The base rate includes: VAT, CASCO insurance, RCA (civil liability), Romanian road vignette, maintenance, periodic servicing, roadside assistance.
4.2. Not included: fuel, fines, parking fees, special road taxes.

4.3. The Vehicle is delivered with a full tank and must be returned with a full tank.
4.4. The invoice is issued in RON at the NBR exchange rate of the issuance date.
4.5. Payment is made in full upon pickup, in cash or by card (Visa, Visa Electron, Mastercard, Maestro), with 0% commission.
5. Deposit
5.1. The deposit is paid upon pickup, in cash or by card. Most models require 0 EUR deposit. Two models in the fleet require a 500 EUR deposit.
5.2. The deposit is fully refunded upon return if the Vehicle is in the same technical and aesthetic condition, with all documents and accessories.
5.3. The deposit is partially or fully retained for: damage, missing fuel, lost documents/keys, failure to fulfill legal formalities in case of accident, theft, or breach of trust.
5.4. If the repair cost exceeds 5,000 EUR (justified by an RAR-authorized service estimate), the Client shall pay 20% of the damage value. If the repair costs less than the deposit, the difference is refunded.
6. Insurance
6.1. The Vehicle benefits from CASCO insurance and mandatory RCA, included in the base rate.
6.2. The insurance does not cover, and the Client shall fully bear:
- Damage caused intentionally or through gross negligence (including stained or burnt upholstery, broken windows, loss of on-board inventory)
- Driving under the influence of alcohol or drugs
- Driving by persons not listed in the Agreement
- Tires and rims (if not resulting from an accident)
- Theft with keys left in the ignition or doors unlocked, windows open, documents left inside
- Failure to present legal documents upon return
- Refueling with incorrect fuel
- Use in competitions, towing, or pushing other vehicles
7. Obligations of the Parties
7.1. The Company shall deliver the Vehicle in good working order, clean, with a full tank and all related documents.
7.2. The Client shall:
- Use the Vehicle according to its intended purpose and user manual
- Not use it for taxi services, driving school, sports competitions, towing, testing
- Comply with traffic laws and bear all fines received
- Not leave Romanian territory without the Company's written consent
- Immediately notify the Company in case of accident, theft, or malfunction
- Return the Vehicle clean, with a full tank, and with all documents
- Not smoke inside the Vehicle
7.3. Leaving the country is permitted only with the Company's written consent. Additional fees may apply. Breach of this obligation makes the Client liable for the full value of the Vehicle in case of theft or accident.
8. Procedure in Case of Accident, Theft, or Damage
8.1. The Client shall immediately notify the Company and the police.
8.2. Required documents:
A. Minor accident (no victims, max. 2 vehicles):
- Amicable accident report fully completed
- Incident statement submitted to the Insurer
- Copy of RCA + vehicle registration of the at-fault party
- Phone number of the at-fault party
B. Major accident (more than 2 vehicles or with victims):
- Official report issued by the police officer
- Repair authorization
- Annex 2, breathalyzer test
- Incident statement submitted to the Insurer
8.3. Failure to present the above documents upon return makes the Client fully liable for all damages.
8.4. For damages caused by the Client (including the vehicle found damaged while parked), the deposit is retained. For repairs exceeding 5,000 EUR, the Client pays 20% of the damage value.
9. Personal Data Protection (GDPR)
9.1. AUTORENT PLATINUM SRL processes personal data exclusively for the purpose of performing the Rental Agreement, in accordance with Regulation (EU) 2016/679.
9.2. The Client has the right to access, rectify, delete, and port their data.

10. Disputes. Force Majeure. Final Provisions
10.1. This Agreement is governed by Romanian law. Disputes shall be settled amicably or by the competent courts at the Company's registered office.
10.2. The Client may contact ANPC (anpc.ro) and the SAL platform (ec.europa.eu/consumers/odr).
10.3. Force majeure relieves the invoking party from liability, under the law.
10.4. The Company reserves the right to modify these Terms. The applicable version is the one in force at the date of signing the Agreement.
